In theory, you don't have to be in the US for any part of the permanent residence (PR)process. A company could do a labor cert and I-140 for you, and then you could complete the PR by interview at a consulate, and only then start working for the US employer. In practice, of course, that never happens. However, it is possible so that you can safely go to India.

Hello,
If one gets stuck with H1b revalidation, and then gets approved after 6 months. Is there any issues when coming back to the US at the POE entry?
Please let me know.

No issues, but make sure you have a updated employment verification letter from your employer saying that you still have a job. I have seen some cases with my friends where the immigration officer asked for a letter when they were outside the country for more than 3 months....One of my friends did not have a letter and the officer called his employer and verified that he still has a job before letting him in....So I would just carry a letter to be on the safe side rather than going through the hassle.....

Employer A - LC applied in Dec 07, Currently on 7th year extension till Jan 2010. Stamped visa.
Employer B wishes to recruit me by transfer H1-B and utilize recapture time. The total time they would get is till Apr 2010 (which includes recpature time) along with 7th year I-797.
Employer B wishes to file LC 1 month after I join them.
Assuming that I join them by end of Dec 2008, I have the following questions about my H1-B extension
Lets consider Dec 30th as the date to start the LC application.
What I understand is that based on the LC from Employer B,
Can I get extension on my H1-B beyond APR 2010.
for 1 yr - Based on LC from employer B being pending/approved until Apr 2010
for 3 yr - Based on LC from employer B being approved and I-140 approved.
Apply for premium processing of I-140 before 60 days of Apr 2010 if LC is approved and I-140 is pending.
Your response is appreciated.

I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.
Question is: Is there any deadline for them to complete processing all cases???
Another concern. When they are done processing all 350K cases, think of retrogression!
DOL claims on their website all shall be done by Sept 2007.

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .
