Hi All,

I sent h1b extension application to california center on june 22nd and my application is still not approved. My current visa was valid until July 30th. I need to travel to India on Dec 10th due to urgent reasons . Please suggest what should I do

1. Can I travel while my extension is pending?
2. Can I raise a service request to speed up the processing?
2. or Upgrading to PP is the only option?

I do have EAD and advance parole through my husband's GC application. If I use parole for travel what happens to my H1b visa and GC application filed through my employer. My visa will still be valid or not?

Please help...

Hi All,

I have got an RFE for my I-485 application. . I missed to complete a question (part3 and question #10) in I-485 form for which I got a request for evidence letter from USCIS. Can anyone has any template on how i should reply. Your help is much appreciated . Thanks in advance

Therefor submit an affidavit with your answer to this question a 'Yes' or 'No' response.

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.
Guys, what is your take on this.

Hello!

I was laid off from Company A on H-1B in May 09. My EB2, India, I-140 was approved in Mar 09. Since PD is not current, I-485 has not been filed yet. Here are my questions:

Can I retain my PD if Company A withdraws(worst case) my I-140 petition?
If I find employment with Company B, can I still file my I-485 using Company A's I-140 petition assuming Company A provides me with an Employment Letter for future employment?
If previous step is feasible and I-485 is approved within 180days of filing, will it pose any issues if I have to invoke AC21? (since I will be working for Company B when I file I-485 with Company A) I ask this because I have 2 yrs and 4months on my H-1B off the 6yr limit and I am afraid I might run out of H-1B time before I file I-485.

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

Dear Adviser,
I am end of my 6th year of H1B and my current employer filed H1B extension using my approved I-140 (and I don't have EAD). However my employer took the advantage of my immigration status and reduced my salary drastically . I am planning to change my employer after I receive my H1B extension. Now I have following questions
1. If I accept new job with other employer and transfer my H1B to new employer, by what time (months, years..) my new employer has to file PERM to continue my GC process?
2. What if my current employer cancels my I-140 when I moved to new employer? Still can I use that I-140 to port my priority date to new employer?
I can plan my future employment based on your response. Thanks for your time.

Can i apply to full time program and if i am admitted, can i apply for change fo status to F1?

Is this switch possible?

Hi All

I am here on L2 and then Joined a Company in 2006. When I joined, that time the H1 Cap 2007 was already over so my company said that they will do my H1 this year. Unfortunatly I got the H1 Rejected as my case couldnt get in the lottery.

In the Mean time my company have filed my Green card under EB3 and we have I-140 Approved (1 st stage) in August 07.

Now, is there any way that anyone can Help me?

Hi I am going to india on july and I need to get my h1 visa stamped as the previous one expired and at the same time my wife needs to get her h4 visa stamped
now when i return back i am planning to bring my parents on short trip
my question
1.Is it possible to book appoinments for h1,h4,b1 at one shot (one day)
2. Will there be any issue if we go in group in combination of many visa

I joined new job using EAD, didn't invoke AC21, my 140 was approved and I filed 485 in July2007.

There was a RFE for geographical discrepancy explanation and EVL from 140 filed employer or EVL from new employer if changed jobs on 04/29/2009.
(Changed address using AR11 after filing 485)

RFE on 485 on 04/29/2009
LUD on 140 on 05/01/2009
USCIS received EVL from new employer with AC21 - on 05/11/2009
LUD on 485 on 05/13/2009
LUD on 485 on 05/14/2009

Don't know whether they are soft LUD or Hard LUD.

Couple of questions, Is LUD on 140 normal when there is a RFE on 485?
Continuous LUD's on 485 normal?

can some one answer ...

I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.
