Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. While this is only the opening round in the case, it does suggest that the defenders of the law will have a tough time convincing the judge that the law is constitutional. 10-1061-447 -

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:

1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. I am starting this thread for the people who are Greencard Holders and not married. Please share some thoughts for bringing their spouse here.
IV can help in this matter.
If all visa holders and citizens can bring their spouse instantly then why GC holder have to wait for many years after getting GC after many years.

All the while we saw people talk about new job matching LC job and not H1 (LCA) job. But it would be nice and safe if you have similar job on LC,LCA, new AC21 job. But mainly the job in LC should be considered as per my knowledge.

I applied for extension of stay to California Sercice Center. But if I move to Texas, will be my case transfered to VSC??

if it is an extension of B2 status, I don't think your case will be transferred to a different center if you move to a different state. you just have to inform the service center regarding change of address(I think you can send a AR-11 form) this is just my personal opinion. please check with the lawyer who filed your extension or other experts

Is there any body who have I485 filed at TSC and EAD and AP filed at NSC. If it is so, will that create problem in getting that EAD card? Since, they check 485 filing for EAD card production. Please advice.

Hi,
Please help me out on this.
My employer provided me with substituion LC with PD: Oct 2002, EB, and filed an I140 using it last year. The RD on it is Nov 2005. The 140 had 2 RFEs both asking for submission of original LC. As per the attorney the original LC was submitted with the application, and the attorney requested the CIS to get the copy of LC from DOL, as per the regulation as she says. Now this week CIS as send a denial on this case.
My questions are:
1. The attorney says, she can no longer get the duplicate of the LC from the DOL, as it's an old substitution case. Is there any other way, or solution on this?
2. The origianal LC was filed along with the I140 petition. Is that usual? Should all the originals must have been submitted only on request?
3. Is there any way to make this case alive again? What are the chances of approval if we reopen the case.

I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

eFiling EAD will result in ASC appointment for code 2 biometics (Finger Printing of right Index finger + photo). You need to take the appointment letter and one form of photo id (passport or drivers id).

I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.
They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.
- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?
Can somebody please help by sharing their experience if they are/were in a similar situation.

My biometrics appointment is scheduled at ATL ASC on the 19th of this month which is a Saturday. Has anyone on this forum visited ATL ASC for any work on a Saturday? Should I call up the USCIS customer service to reschedule my appointment? Or, do I need to be happily surprised to see my the USCIS working hard for me even on a weekend? ( The later part sounds like a 'Bizzaro World' from Seinfeld )

Talk to an attorney he should be able to kiss your employer's ass with lot of things.
If your employer is paying more than what is mentioned in H1B, then you cannot do anything.
If you are working on % basis, then forget about 14k if till you work for him, prorate of H1B pay is paid.
