I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? I filed for my wife's 485 on July 2nd. Assuming USCIS accepts/issues a receipt, how does USCIS decide which case to pick up first, would it be based on RD OR would the case get priority over other cases since the primary applicant has been approved? Any memos, opinions around this?

I'm on H1b visa in my 6th year. Perm application has been filed and I hope to get it approved soon along with approved i-140 (fingers crossed).
From what I have read on this forum so far, H1b transfer to a new job after an approved I-140 seems to be possible even after 6 years on H1. My issue is that I currently work for a university (non-quota H1) so if I get a new job most likely it will be with a for profit company which would require me to get a new H1 (and not H1 transfer).
So, the question is whether it is possible to get a new H1 after 6 years on H1?

My labor is approved, but haven't received approval from immigration yet. Online status is showing it is 'CERTIFIED'. Can I file I-140/485 with just electronic confirmation of labor in case if it get delayed in receiving approval? Bwy does anybody have an idea in how many days immigration will dispatch the approval copy of labor after it is certified?

My h1 is approved in this years quota but i have not received I797. During this period if my h4 is stamped will my h1 be cancelled. or can i go to US on

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

A pretty serious accusation. Phoenix Law Enforcement Association president Mark Spencer accuses the Arizona city of inflating its kidnapping numbers to bolster its claims to stimulus money. Scenario
L1 & I94 valid till late 2011 with comp A
new H1 with comp B approved effective November valid for another 2-3 years
Can some one still continue working on L1 or one must have to surrender L1 and need to switch over to H1.
What is the valid time period he can continue on L1 with comp A.

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.
