Hello,
I am sure others might have noticed that 485 processing dates at NSC (for example) have literally crawled from the beginning of the year to now. Here are the processing dates (per USCIS status).

Thats roughly 9/10 days worth of 485 processing from mid-Jan to mid-Jun 2008. I wonder what the processing date looks like for the mid-July status update (which should probably be out tomorrow).

Is it ok to use this form though we will be filing the I-485 on 07/01/07.

Yes. The old labor is valid for 180 days after July 16th.
If your lawyer can establish that A is still alive in some form, then this is possible. The new avatar of A (B or AB) can apply for 140.

Hi,
We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?

Recently I have travelled to USA on B1, during port of entry at chicago the immigration officer as marked Advised on the stamp with pen. What does it mean? Does this will have any impact on my next visit to USA on B1.
In port of entry letter I have mentioned stay duration as 4 weeks (1 month). Is this the problem? If so why officer given i-94 till 3 months?

This is really major and thanks to reader gg for posting the link. The headlines are likely to be about the benefits to people out of status. Can USCIS be sued for picking files in random ( the only time they budge is when a federal judge put an order ).
Ron Gotcher: Anyone can be sued for anything. In the absence of a large, well funded group of plaintiffs, however, I don't see this kind of suit going anywhere. For now, the remedy is Congress. Organize a group to initiate a letter writing campaign to Congress. Write to your own Congressman, your two Senators, and the chairs of the Senate (Kennedy) and House (Loftgren) immigration sub-committees. Get the facts straight and offer as much emprical evidence as possible. If Congress were to receive 100,000 such letters, they would definitely do something about this problem.

My case: NIW 140 approved, PD 2006/10, now 485 pending. But I am leaving USA to another country for a permanent job. I am not sure if I should withdraw the 485 or just convert it to CP.
1. Will it be possible for me to get the green card thru CP if I get interviewed and can't show any ties with USA? Can I enter USA during CP? I hope to have green card in case I don't like my new job and come back to US someday. But I may just cancel 485 in order to affect the least my future visiting visa application. Suggestions?
2. I am on H1 now, but H1 will expire 1 month before I leave USA. So I understand that I can stay legally on AOS for the one month, true? Do I need to do anything for switching from H1 to AOS? Again, I need to come back to USA for business/visiting, so I want to do everything right not to harm my future non-immigrant visa application.
Thanks a lot for your inputs!

Its not an issue. Make sure u fill all ur future applications like ssn, green card etc as per your passport. also ur birth certificate should be like ur passport details name date of birth and place of birth.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct?
