Hi
I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?
Thanks in advance for your advice!

I am in US and have changed a job recently (changed status from L1 to H1 while in US). I plan to travel to india soon in Feb 2010. My passport is valid till March 2011 and my H1b approval is till 2012. Will this be a problem for me when I go for stamping in India.

On the EAD application form, Q15 asks for the current Immigration Status.
What will be the immigration status of a person who entered US on H4 visa but started working later using EAD?
Since I-94 has H4, Is it OK to mention the immigration status as H4/AOS Pending ?

I need to travel out of US urgently because of family emergency.
1) Can I get emergency AP from local/district ofices with supporting documents
2) I saw that I can travel until I get my AP approved.Has any oine denied entry because of they travelled out of US while ap processing is pending.Any experiences..

MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.
What are the limitations in this path. Do we always have to be in USA on valid H1B.

only for 2 months. You should ask a friend to monitor your mail. Sometimes USCIS just sends FP requests out of the blue. At least you will be able to call and reschedule the FP.

My I-485 case has been transferred from Texas center to Nebraska and notice says it's for faster processing. My priority date is Nov 2003, EB3 category, indian national. I didn't expect they would be looking at my case now. Why would they transfer it? has anyone received any such notice?

Hello,
I Need an advise on my H1-B extension.
I came to USA on on L1 Visa in 2003/March and I was on same visa till Dec/2003. ( 9 months).
In 2004 Jan I filed H1-B and my status changed from L1 to H1-B. Again I filed 2nd extension (for next 3 years) on this H1-B and I got this approval upto given till 2010 Jan.
My question here is can I wait upto current H1 - B approval validity even though total stay on L1 + H1-B is exceeding the 6 yrs ?
OR do I need apply for H1-B extension on my approved I-140 (curently in 485 stage of my GC) to get 3 more years extension as 2010 Jan will be my 7th year in USA ?

I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

As PERM processing becomes faster in recent months, icert problems continue though. DOL has reported that the incorrect error message that pops up upon entering a date for the prevailing wage source is the result of recent system edit. The glitch will not affect useability, i.e., users can bypass the error message and submit LCAs for processing. In addition, a fix is in development and will likely be in place today or tomorrow. Common recent problem is receiving an inappropriate system warning when entering the Prevailing Wage source. We hope these problem will be fixed soon as the PERM process becoming rather annoying. We will keep our readers posted.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. Therefore, individuals that have a pending I-485 are encouraged to apply for Advance Parole before traveling abroad for easier re-entry if the circumstances of their current status changes.

Hi All,
I fulfill the requirements of AC 21 (485 pending for more then 2 years and I 140 approved long back)
My current project is not my employer's client. There is one middle vendor from which I have got this project.
Now, I have heard that many consulting companies make you sign a contract which states that any client you find becomes their client and therefore forbidding you to join them directly. As we usually dont see papers while signing I am not sure if I did sign any such thing. My question is, if my employer sues me on this clause, does it hamper my I-485 processing? Any input in this context would be highly appreciated.Tension is killing me
