I missed this news.
Who can apply for 485?
My Labor was approved and I-140 pending.
My PD is Feb, 2006.
Can I apply for 485 now.
My both daughters are in India.
If I can apply now then I will have to bring my daughters immdtly to U.S.
Please can some body help me.

Simple and yet we have not acted purposefully. I have a strong feeling that this visa grab is still going on. HLG has sent out another immigration alert to all registered emails, similar to one posted on Feb 9, 2007. . And I quote a bit
Stopping this 'unused visa grab' for only one section of retrogressed and demanding it for all retrogressed is a sure WIN for us, if it happens; if it is stopped, it will make a tectonic shift the focus to the whole gamut of issues of retrogression, backlogs etc and will put more pressure on Congress to act.
I have seen and read all the posts in this thread started by me. I appreciate all points and posts, particularly by core team.
The least we can do is write and fax to Congress and demand. The IV team should set up a fax, so that each of us here can protest these moves by Congress without considering other severely backlogged applications. For this I propose a simple message.
Next one/two days are crucial. Let's make a difference.

Following is copied from Greg Siskind's Blog, and it makes me wonder if it means that those who who filed I-140 by mail can submit I-485 with the I-140 receipt number only that can be obtained from the cleared check?

Guys, temper your expectations. Cust Service Rep at USCIS are not trained to answer the questions that pertain to things like visa bulletin's effective date and whether or not they will accept the ones or reject the ones on July 2.
Cust Service Rep is for general information for those who cant or wont use the USCIS website and other sources of information on the internet. Or for those who dont speak English.
Cust Service is not intended to provide complex answers. Last I heard, even the Vermont service center folks didnt know about bulletin revision and they were turning down 3-year extension requests for H1 visas thinking that the bulletin is current until confronted by lawyers who said that bulletin is unavailable and now there is reason to give out 3 year extensions instead of 1 year extensions.
If Vermont service center was unaware of visa bulletin revision, then what do you expect from a Cust Service Rep who is trained to answer questions that cover information that can be fit in 20 pages ??????

Most EB2's who are talking on this forum are idiotic, egostic and too much of themselves to think straight. Case in point Smugbee, SNathan and TonyHK. Since they don't have ead they want ead and thats all they care about. As long as they get to file 485 and get ead they dont care.
When an eb3 complains about waiting for GC he/she is a whiner and has to recognize the superiority of an EB2 getting GC before EB3 even if teh EB2 is 1 year in thsi country and EB3 has been waiting for 12 years.
When an eb2 complains about not having ead his concerns are valid and nothing else is more important on IV thean that
Eb2 are there in Eb2 for a reason and Eb3 are there in Eb3 for a reason.

About the funds .. you know the answer and logiclife videos tells exactly the same. But you said I know nothing about the funds. What exactly you are looking for. Money spend on each event? i think they started doing it. Recently pappu mentioned they need 41k for the rally.. I think we are improving on that front ..

a) ban EB3-Eb2 porting
b) or EB1 abuse
c) or eliminate country quota
d) or recapture the visa
e) or don't count dependents in EB category.
f) or abuse by body shop consutling firms
g) or Automatic GC or citizen after x years........
h) ..... list goes on..
.. if all could be done @ same time - it would be perfect..
The officials at DHS/USCIS read your message and all your wishes are granted.

Guys who got NOID/Denied 485, quick question.
Looking back, do you think it was worth making the job move using AC21? Is it really worth the time, money, anxiety, sleepless nights that you go through during NOID-MTR?
For people getting layed off, they have no choice but to use AC21, but for rest of us, why not continue with the job you are currently in and let the GC take its turn rather than risking it?
PS: I am in US for past 5 yrs with May06 PD. I am just trying to get an opinion here, so don't flame on me. I was comtemplating on using AC21 but reading all the NOID stories, i am bit hesitent now.

My current employer has assured me that they will not revoke my LC or I-140. It is a huge company and I think it will stick to its word. It will not have any use for the LC, I-140 anyway as the whole group was laid off and the product moved to India.
So, it seems that if I transfer to company B they will be able to file for an H1 extension beyond 6 years based on I-140 approved with company A. I can then start my GC process with B again while keeping my old priority date.
Once again, all your replies were immensely helpful.

When H1-B yearly cap is getting used up within days, what is the reason for allowing H-4 to work.
The only way you would see a change in the rule is when there are not many H1-B takers, and they need to attract more families.
Don't get me wrong, i am not trying to say H-4s should not be given the oppertunity. Just think in terms of the need for this country. Not our personal needs.

What could be the reasons and how i Can track about my case.
Can I track my case? is there some number where i can call discuss about my case why I didn't receive my receipt
My Lawyer called the USCIS and they are saying that they are not able to generate the receipt number?
