YES Baby!. I am making it to the Sep 18th DC Rally. I am also bringing my parents (who are visiting US) along with me to the rally. So, total count is 3.
Initially, I was planning to take them to just NYC. Now I changed plans and decided to show them DC as well. Since we are talking about Washington Monument and Capitol Building, I don't think they will mind at all :).

From your I-485 denial notice and reading some of your posts in this forum it appears that the underlying I-140 petition has been revoked by your previous employer.
I dont think they substitute it for some other employee, their is no such concept as using the approved I-140 of a individual employee to use it for another employee.
Theis is the possibility that they revoked your I-140 and used the underlying approved Labor certification for another employee, or if they have any grudge
or for some other reason revoked your approved I-140.
If you were holding an approved I-140 and changed your job after 180 days of filing your I-485, then you have good chances of winning MTR.
Please consult attorney Murthy or Rajeev Khanna. I heard they are good at handling these type of situations.
Make sure you have the valid job in a similar profession as what your labor states and your are in legal status (H1B) with the current employer.
Technically you can not use EAD until they restore your I-485 petition.
Wish you good luck and hope you will have a successful outcome.

Hi, we recently applied for COS to H-1B at California Service Center on May 26th under premium processing. So far we have not received even the receipt notice, neither have the checks been cashed. Just wanted to check with everyone if this is normal, or did they misplace the petition?

I applied for my labor during sept 2002.Just before my labor getting cleared, they started this BEC 's and sent my application to PBEC and it it was cleared during 2006 April.( after 3 and 1/2 years)
During this period I got one year of extension for my H1B and sent papers to the attorney for I-140.That stupid attorney did not file my I-140 for the next 4 months just like that.( god only knows what happened bw, my employer and attorney). and at last we changed the attorney and applied for I-140 during 2006 November. and during 2007 Feb I put my I-140 for premium processing.
Before I get RFE for the premium processing , the USCIS mistook my employer name with other employer and denied my I-140.And again After the attorney clarified them about the RFE , they Put my I-140 into Abeyance state. I am with you buddy, but u have to understand
1. AILF will not file such case as they dont have big numbers of people supporting it as plaintiff
2. Your reasons are justified but you forgot one thing: US govt agencies (whether it is USCIS, DOS or DOL) treat immigrants as with the principle "beggars are not choosers", so per them you as an individual and your feelings doesnt matter much
3. Try to think positively, even though everyone will file 485 now but come Oct and if your labor is approved by that time you will be much ahead of everyone and you will not loose your place in the line. I am sure u will get GC approval before most of the July filers

You could have called the local finger print office, and asked to move to another day because of travel. They let me come in 2 weeks early because of a flight. I had tickets in hand but they didn't ask to see.

mind your language.....i just wanted to get an update...there was a big momentum built around passing the i-485 provision and now we are postponing it till CIR....We are also changing lobbying firm....These are two significant changes. First, the initial promise made to members is not being delivered upon and second, we are changing a firm that we have utilized for a year. Are there some problems going on? May be, the firm ditched us.....Look, all these are questions going thru my head....That's why I posted the question....I am bold enuff to ask the questions, rather than sit back and blindly believe whatever is fed to me.....I do not own IV and I don't want to either....

I understand your frustration ,When we had to wait for our labors approvals even we have gone through the same sleepless nights and mental frustration.
Why dont you seek IV's help...They are really supportive and this website is a real boon for us all.Today we are able to get updated information of what is going on.
Seek their help...I beleive IV willd defnitely help in this issue.
By suing I dont know how far its going to help as they have clearly mentioned Sep07 for all traditional cases.Seek help from IV.

I have a dream: IV team carrying at least 10 big boxes full of letters to show during the meeting.

I like this and rallies at state capitals, because it would be easy for everyone to attend in their home states, but there might be small numbers in many cities that would not bring much attention
I also like letters, flowers, etc in mass
And also, how about:
The broken system is causing a reverse brain rain, right? Well How about we:
1- Each one of us buys 10 bath tub stoppers (you know, the stoppers you use when taking a bath, to stop the water gig down the drain) and mail them to Congress, Media, USCIS, etc- With a letter "Please stop the self-inflicted U.S. Reverse Brain Drain, already 100,000 highly-skilled have left, stop the 10-year green card delays for LEGAL highly-skilled immigrants"
2-At the same time, we ALL send WHITE roses to Congress (Roses are now IV's trademark, we are known for them and the peace they mean, and roses should probably be on IV's logo too) Attach same note

I guess there is very little follow-up on this issue.
Even I tried to get an SSN for my spouse (H4) and was turned down... I asked the lady on the counter to give me a denial letter and have it with me. Maybe it will be of some use later in this process.

The text for HR 5140 Economic Stimulus Act 2008 has the following eligibility criteria:-
ELIGIBLE INDIVIDUAL- The term `eligible individual' means any individual other than--
(A) any nonresident alien individual,
