Hi All,
I got a notice from uscis on sept 24th stating that my 485 has been withdrawn as my previous employer withdrew my 140. I filed in july 2007 , and ported to a new job in April 2008. I filed an MTR on 24th Sept, but the status of the MTR is still received and pending. Its going to be 180 days since my 485 has been withdrawn on march 9th. And my lawyer is saying that i have to leave this country if we dont get the MTR accepted before 180 days.
Gurus could you please suggest some ideas on all possible steps that can be taken..

As per my knowledge, your lawyer waited too long and he/she may not be very well versed in immigration matters. When MTR is pending and If you do not receive anything within 60 to 90 days, you should immediately file an appeal in court. Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.
For me, only person who could move to Canada is:
1. Way better career jump.
2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
3. Keep the GC processing alive in US.
I think Canada might be a good option for some ppl. Here are some reasons:
You move to canada, have greater flexibility to change jobs, your wife gets to work, in the meanwhile your employer lets the GC process continue. This way, you live a free life until you get a GC. But I seriously doubt if any employer will continue to process GC if you leave the country.
Or you have waited long enough and are too tired to wait any longer. You would rather be elsewhere. In this case it doesn't matter where you go, Canada or back home.
Another good reason can be that you have waited for 8-10 years in US and have no hope in sight. You are not tired but you can clearly see that the wait is completely futile and you are just hoping. You have decided to stop waiting but still want something that's close to US standards. And I think canada still comes very close to good standards.
What do you guys think?

Sorry that I could not reply sooner. In this case, I went ahead and did an Info Pass appointment. The officer there went ahead and gave a 1-year temporary stamp and said he was ordering card production. This was in July and I am still waiting. My lawyer said "congrats"! No idea how to handle this going forward. What happened to your case?

What is the use of double masters and MBA from Harvard/Kellogs if you cannot get promoted. With all those degree on hand, you will still end up doing what you were doing at the time you filed for your labor.
Thinking about these options are good if and only you are sure that you will have your GC when you complete your studies. MBA is worst as it will have negative impact on your career if you continue to do what you were doing even after your MBA completion. Down the line when you get GC, you cannot substantiate your motive for MBA which is really going to HURT your carrer. MS is lot better then MBA.
If you are really interested in MBA, do prepare for GMAT / TOEFL , take the exams and keep your scores ready. Start doing some volunteer job / community work. Volunteer / non-profit work / community work will add some value to your resume to show your leadership skills.
DONT DO THE MISTAKE OF DOING MBA IF YOU ARE NOT SURE TO GET YOUR GC BY THE TIME YOU COMPLETE IT. IF YOU DONT GET IT, YOU SHOULD HAVE THE GUTS TO KICK THE US CAREER AND TO GO WHEREVER YOU RE EMBRACED FOR YOUR SKILLS/EDUCATION.
I agree. I realized that I was paying too much for my MBA from a top 15 school and I decided to put on hold for that exactly same reason. I received job offers from employers which were willing to pay 100% of the MBA. Of course I had to decline due to my status.
Also, interest rates in private loan banks are very high. I thought more about it and decided to put the damn MBA studies on hold and wait until I can change jobs and let an employer pay the thing for me.
My advice is for people to watch out carefully. MBA can get very expensive and you may just actually making your hosts happier, not necessarily you !

Rather than mentioning it as our right,we need to make people aware of how we contribute and why we deserve a green card.;)

You are right, nobody should force you do anything, everything is a personal choice, well only after you have attained a certain age (you don't have choices as a infant ;)). I bet you don't have a convincing answer for that. Therefroe, it follows that CIR (even if it is not ideal) will be better than no bill being passed.
And all those anti-CIR folks please get this : It does NOT give instant citizenship to anyone, nor does it put these folks ahead of us in the line. The core team had repeated this several times when CIR was under discussion. CIR is definitely not ideal for us because of the possibility of collateral effect from USCIS being overwhelmed, but is that worse than our current situation of waiting till retirement for our PDs to become current ?

That is particularly true for us .. those who who are against illegal aliens are also against high skilled legals with a few honorable exceptions like Cornyn and Kyl. If that wasnt the case, the house and the senate would have passed SKIL in a jiffy by now. Its best for us to remain neutral on the illegal alien issue .. and back it to the extent that it benefits us through a piggy back ride.
How does passing CIR help us? I didn't really have the energy to go thru the whole bill but it didn't specify what "line" those 20+million ppl who eventually get amnesty will be processed in. If they line up on EB3 or a supplementary bill in the future decides to allocate some EB3 to a "Schedule B" (just for example), then we are right back to where we started (but add more years to the waiting).

Well. It certainly is a good news. Atleast for me. :) I would like to caution though that getting current does not necessarily mean getting approved. We have had cases from 2003/2004 PD members where they did not get approved for long time despite their date getting current.

never worked for "employer x" after H1 transfer, perhaps you are out of status. What is your lawyer saying? You never transferred H1 back to emplyer#2?
H1 doesnt work as you are interpreting. OP was working for 'A' and had a valid H1. At some point of time, he got a job offer from X and had his H1 transferred to X. Even though his new H1 is approved, his old H1 is still valid. It is valid as long as OP doesnt join X. Since the OP never left A and never joined X, he was always in status. OP -> this should be a simple case. Since you have documentation to prove that you were in status always and since you never joined X , you dont have paystubs and that should be perfectly fine as long as you never left A.

I was also thinking that we can possibly learn a lot from the protests by undocumented immigrants. They had record turnouts in their rallies and most of their people stayed away from work to take part in the efforts when ever there was a call for the same.
With all due respect, it was a disaster. They ended up scaring Americans - by holding Flags of thier countries, holding US flag upside-down or disrespecting US flag in other ways. This provided fodder to anti-immigrants to scare Americans of an 'invasion' of law-breaking aliens.
We need to learn lessons from them, in not committing their mistakes
