Vinn,
Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!
TIA
Great points. Is it possible for the primary applicant to continue on H1 and the secondary/dependant applicant apply for EAD?

I did not want to initiate that discussion because it may be a long one, but let me share my experience:
My recommendation is that folks take an MBA only if you already have a firm position in mind that you want to go for an executive or upper management position in the future. That line of thought is specially applicable when you are paying the whole thing from your own pocket !!! Before working in a management position or taking the MBA, I did not know how much I liked the idea of becoming a CIO or CEO. I tought I knew it, but until you actually experiment it, as many things in life you don't know for sure. Well, after completing 50% of the program I realized that was not my short or mid-term goal to work as an executive reading accounting net income balance sheets or maketing professional, even if I had the GC handy.
In my personal opinion, taking an MBA merely to enhance your project management when you are PAYING FROM YOUR OWN POCKET it may be a very bad strategy. If others are paying for you, of course that is fine, but it is not the case for many of us. I had only one or two courses related to project management anyway.
If you just want to enhance your project management skills, you might want to invest in way more direct courses such as PMP, ITIL, Microsoft Operations Framework. You should be able to complete those with a fraction of the cost and time of an MBA and probably achieve more return and knowledge than what the MBA can offer you when it comes to project management.
For those who are sure you want to read balance sheets, work with marketing analysis and go away from the hands-on experience, then MBA may be right for you.
I don't want to discourage you, but there are documents out there showing that MBA's are overrated and the importance of it is under scrutiny. Since I already found offers from multiple employers who were willing to pay 100% (if you are a qualified professional like us, it is not difficult to find employers willing to pay for it once you can change jobs) personally I thought I could wait a little longer to get the MBA and invest in IT certifications now paying from my own pocket.
Just my humble opinion.
I dont mean to discourage folks here...
But here is what I have seen more often with MBA. Techies like programmers, business analysts in IT sector have done their MBAs from good schools and ended up doing the same job EVEN WITH GREENCARDS.
I have seen GC holders doing MBA and then after finishing MBA ending up with same job description with a 5% increase in pay.
So please do your research in HOW MBA is going to help you in your situation. Your job and your INTENDED JOB POST MBA may not really need you to have an MBA. And I have seen this way too often. So think before you pluck down 30,000 dollars on a degree that might do little benefit financially after you complete it.

My Lawyer didn't file my I-485 until July 7, 2007. He never replied to my e-mails or my phone calls.
My whole experience with them appeared to be as if I know more than them. It appeared as if I had to educate them about the development.
Considered changing lawyers and also considered filing on my own. But finally thought to ahve atleast soem attorney whom i know(at least i know what can expect?).

USCIS reps did not mention any specific group to me. But what I was told was that, everyone's information should be in the USCIS system by August 1st. So urs would be too.
The group was just my analogy.

Reform Immigration: While highly skilled immigrants have contributed in beneficial ways to our domestic technology industry, there are plenty of Americans who could be filling those positions given the proper training. Barack Obama is committed to investing in communities and people who have not had an opportunity to work and participate in the Internet economy as anything other than consumers. Most H-1B new arrivals, for example, have earned a bachelor’s degree or its equivalent abroad (42.5%). They are not all PhDs. We can and should produce more Americans with bachelor’s degrees that lead to jobs in technology. A report of the National Science Foundation (NSF) reveals that blacks, Hispanics, and Native Americans as a whole comprise more that 25% of the population but earn, as a whole, 16% of the bachelor degrees, 11% of the master’s degrees, and 5% of the doctorate degrees in science and engineering. We can do better than that and go a long way toward meeting industry’s need for skilled workers with Americans. That being said, we do not want to shut our doors to innovators from overseas, who have traditionally helped make America strong. Barack Obama supports comprehensive immigration reform that includes improvement in our visa programs, including our legal permanent resident visa programs and temporary programs including the H-1B program, to attract some of the world’s most talented people to America. We should allow immigrants who earn their degrees in the U.S. to stay, work, and become Americans over time. And we should examine our ability to increase the number of permanent visas we issue to foreign skilled workers. Obama will work to ensure immigrant workers are less dependent on their employers for their right to stay in the country and would hold accountable employers who abuse the system and their workers.

Nothing succeeds without leadership and proper plans. If we go by the current rule - every one is a leader - we will learn soon 'Too many Cooks spoiled the broth'. If each person steering the boat paddles in a different direction, boat will go in circles.
Focus is the most important factor in success. Right now, I'm focussed on what's getting posted here, as I don't have anything else to focus on till I hear the next secret broadcast , which I never get.
Sales/Marketing is severely lacked in promoting State chapters. IV website does provide good info on filing 485, other forms, suggestions etc. What's the incentive in becoming a State chapter member? What are the costs vs. benefits? Unless people find benefits they'll not volunteer. It's hard to sell only 'action items'. Baits such as Free legal help, help filling Immigration forms (by experienced members) etc. may motivate people and make them sympathetic to our cause.
If we stick to 'Don't ask what we can do for you, ask what you can do for us', we won't go far with it.
This makes sense. Every individual is looking for a personal gain behind the bigger cause. Hate it if you may, but in general individual think first personal gains than for a cause unless they are big hearted. I dont think every one on IV is big hearted other than the core. Showing some personal benefit through IV would definetly trigger the individuals to volunteer more. Why people hop on to IV now is because it gives some thing personal to them ( may be for now some good immigration info which they dont get else where- that is the benefit for the individual).
I guess IV has already been doing some of the beneficial activities for the members like weekly legal clarifications /meetings, etc. May be some more of these activities that touch the personal lives would definetly bolster the participation for the bigger cause.
My 2 cents

Hey guys
Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.
Sorry to hear about this but
If your employer revoked I-140 after 180 days of filing 485 and you did work for the employer who filed 140 for 180 days after filing 485 you will win with USCIS. Wait for the denial notice to find the reason, then file for Motion to reopen with your lawyer's help.
Your employer should not have revoked 140 (bummer) and if he did it after 180 days it cant be the reason for denial unless someone at USCIS just did the job in their usual way (read they dont read rules which they should follow day to day)
Hope it helps! Good Luck

Sometimes it does not depend on you, I am in Backlog due to my company's lawyer does not want to file for PERM  . Anyway I am changing jobs and starting again but this time with PERM. :D
I understand your pain ( in fact i also could have been like you with BACKLOG LC clearing in SEP 30th ) .... Company dont want to file PERM because they can get you trapped for longer time !
My company didn't do a EB2 filing for me secretively so that i remain chained
with them longer - But now everything is current....
Lets hope your LC comes by the time PD remains Current.

Hey Dhundhun,
I have one more question.
In EAD form, Q.11 Which USCIS center and Date(s).
What date we have to write? I am trying to fill up the pdf electronically. So it is allowing me to write only one date. So it should be the start date of previous EAD or end date? or range of date like 07/11/2008 - 07/12/2009
It is not range. It is the USCIS receipt date for previous EAD application. So you have to see previous I765 application receipt. For on-line all the information will come like this:
Location where I-485 is pending: USCIS ???????? Service
11. Multiple Applications for Employment Authorization
USCIS Office: USCIS Xxxxxxxxx Service Center
Date for Application: ??/??/??
Results: Granted

Here are my observations:
* Fragommen, National - if you sre shelling dough out of your pocket, stay away from them. They are a corporate law firm & if your case gets into a mess, you'll end up paying by the hour. Their rates are higher and you will not get personal attention
* Greenberg Traurig, National - Dealt with them at a corporate level. Their team from DC did not have answers to some complicated situations that we had in our organization
* Murthy, MD - Sheela is good. She is aggressive and creative but they don't pay attention to detail and have good churn in their staff. Take into account you will not deal with Sheela herself on a day to day basis, so no point going to her firm
* Thomas Fan, MD - dude is in Baltimore. Avoid his firm like the plague. I know at least 2 cases where this guy has screwed things up bigtime AND washed his hands off the mess he created. These 2 cases eventually moved on to other firms & were successful
* Ellen Krengel, CA - Ellen is certified to practice in IL but lives and works in CA. Very approachable, empathetic, she will research things for you and keep you plugged into the situation. Relatively junior attorney but is commited to the cause
* Gowda, MI - Similar situation to Murthy. Firm's day to day work load is taken care of by junior attorneys not Gowda.

Reason is obivious. There were no demand for GC as the date was way back. So they moved 2 years for June. They were not able to process application in 10 days time so still no demand is there. So they made it current. I think it may be current for a few months. They can process only those who cleared finger print. So First they will process the applications which are filed some time back and after filing PD dates went back. It is simply supply and demand in gc numbers.
Many calculations wrong because companies like TCS, Infosys are not processing gc and they are top users of H1b. PD will go back after a few months but may not be very worst as feared. Anyhow IV is trying for legislation to file I485 and now it is not needed atleast for a few months.
we all know about the VB which current now. I myself am happy to see this. But my question is why all of a suden it became current and what will happen in future?
