I am new to this and I sent email couple of times and called certain people in IV list.
Most of the responses from the senator/congress members or even conversation refers undocumented immigrants, safe/secure borders etc.
What is missing in representing the EB community different to illegal immigrants ?
Yes, you are absolutely right!
We do not get any attention, because we do not raise our issues and we are not vocal about the problems we face. Now granted, we are a small minority compared to the huge lobby and muscle power the undocumented have. But we need to educate the lawmakers about us. We face real issues and our lives have been held in limbo. We have done everything right, played by the rules, stood in the line, pay taxes, contribute to the society. To get this message across, we need to visit lawmakers offices, and educate them. That is exactly why we have the phone campaign, that is why we have this email campaign.
This advocacy and raising awareness is an ongoing effort, it cannot be a one day or one month thing. We will not get anywhere overnight, perceptions have to change, there is a whole lot of dynamics at play. The timing, legislative calender and politics in general. But we as a group need to stand up, talk about the issues we face and have our voices heard.
That is why - we have the DC Advocacy event - Where members will do presentations with legislative offices, educate them, then there is a media event also planned. This is all to raise awareness.

Totally agree with you. I know guys who worked in production support and QA applied in EB2. At the same time people like me in positions such as Architect went with the ill-fated EB3. It is sad, but is the truth.
Hate to burst your bubble. But you have an attitude problem. What makes you think that you are in architect position due to your superiority over others? I am also an architect but if the QA guys didnt fix your shit, your bridge would collapse on inauguration.
Also depends, what are you really doing as an architect? Building a supply chain infrastrucuture for your company?

See the bold text. Because the bill is yanked out, amendments are added to the bill and now it is going to be put back as a new bill.
http://www.heritage.org/Research/Immigration/2007legislation_2.cfm
The Senate's Second Secret Immigration Bill
by The Heritage Foundation
FYI
For weeks, Americans were told that there are only two options for dealing with the nation's illegal immigration problem: stay with the status quo or accept a "grand bargain"--a tenuous behind-closed-doors deal, first made public by The Heritage Foundation, which contained nearly 800 pages of flawed policies. In the face of overwhelming criticism from all sides, this legislation was withdrawn from the Senate.
Now, an altogether new bill (S. 1639) has been introduced by Senators Ted Kennedy and Arlen Specter. It seems to incorporate the previous legislation, with some amendments. After it is read into the Senate calendar on Wednesday, the Majority Leader will be able to proceed to consider this legislation anew at any time; debate is likely to follow later this week, with a final vote very soon thereafter.
This schedule will afford lawmakers even less time for consideration and deliberation than they had before. It will deny them the various procedures long associated with America's deliberative lawmaking process--hearings, testimony, committee debate and amendments, floor debate, and the possibility of further amendments. Instead, according to reports, this legislation will proceed based on an altogether new and expedited procedure designed for the sole purpose of forcing the bill's many ill-conceived policies over legitimate minority objections.
As it has before, for the sake of open deliberation and public education, The Heritage Foundation is making this legislation publicly available to encourage widespread debate and discussion. Heritage Foundation analysts will be reading this legislation and considering its implications--as will everyone outside the confines of the narrow group that conceived it--as quickly as possible.

Including the House session and Conference session, if somehow this is pushed beyond October 1st 2007, then the enactment will happen on October 1st 2008. We have to hope for that. That gives best possible window for all BEC, PERM-BEC candidates and people who have not filed their I-140s yet.
The impact is on H-1B renewals beyond six years, with the cut-off proposed at six years. The only exception for renewal beyond 6 years is given explicitly to people who applied for immigrant petition. So BEC/PERM-BEC people should apply for I-140 asap.

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.
I hope you assume this as a new H1B not a transfer or else your post is wrong.
Do not give misleading information. When you do the transfer the original visa is not cancelled. In fact you can have more than one H1B at the same time and work for them. For example two part time jobs for different employers. But the only catch you should always work only for the sponsoring company. If you decide not to join them at all, you can do so. But you have to maintain the status thru your current employement or another employer.

Thanks. I know I am bugging you with my questions because I am filling all the forms today and sending. I have one question :)
For AP documents, it says we can submit any document issued to you by USCIS showing your present status in US. Now, currently I am on H1B. So should I send them my I797 approval document or EAD copy? Also in there instructions they are asking to send copy of an official photo identity document showing your photo, name & DOB? Can it be PP/DL/EAD?
Your status will be shown buy copy of I485 receipt. AP requires the following:
AP renewal e-filing (to be Mailed):
.... Confirmation Page
.... Two pictures with A# on back, put in envelope and staple to confirmation page
.... Copy of I485 Receipt Notice
.... Copy of previous AP
.... Photo Id such as
........ Copy of Biographic Pages of Passport or
........ Copy of DL or
........ Copy of EAD
.... Letter - http://immigrationvoice.org/forum/showpost.php?p=257924&postcount=20

Bestin, I looked at your signature, and felt very proud for you. You applied your labor in July 2007 only, and you are fired up to support and contribute to the cause. It shows how aware and alert you are. It shows how you refuse to face this unfair system. It shows that you want to fight for your rights....
I wished i were here before (IV) but ofcourse its human life isnt.We learn from experience. If at all IV was here before or if there were active forums like this earlier i am not sure if i would have ever thought of coming to US.Now after coming here and learning lessons its almost like we are stuck- not only on immigration but also to maintain our commitments. There were phases wherein i was literally upset on my decision to come to US which i beleive most of us would have gone thru at one stage.
America always vouches freedom for all,but they missed the point that there is literally no freedom for those who come to US by ethical means.See the plight of USCIS.Its like a monopoly.U can hardly question.A simple example is my wifes L2 EAD.Once she got the FP notice and receipt i sent all relevant documents by USPS delivery confirmation .At the 90th day they issue an RFE asking for the same documents. If it were in India it would have been used for packing samosas. But who knows what happens in USCIS.Now we need to wait again. Can we question them on what happened to the documents i sent? Its unnecessary waste of time.I beleive its high time USCIS thinks on outsourcing to be more effective..
I am not saying Indian Govt offices are better.
Just consider howmuch we spent on GC filing?I personally had to spend for filing and attorney and medical approx 7000$ (ya i had to use my company attorney as my labour was approved in last time). If atleast 200000 people did spend atleast 5000 ,then see how much we spent .Atleast 1000,000,000 dollars inside America during June to August 07 out of which atleast 50% to USCIS for something which MAY OR MAYNOT happen after years. And again a confirmed money 1500-2500 dollars every year for attorney+uscis fee for EAD and AP.The figure which i mentioned is just for an example, the actual figure might be twice.
In addition we spend on travel .A typical Indian Trip for a family of 4 would cost atleast $5000 on Air.If these taxes are considered see how much we contribute. And yes we pay for SSN,medicare for americans to enjoy at florida after 60.
Inspite of all these, some people here think we are just to steal their jobs and send money to India. If people dont realise they are competent, then their way is to oppose immigration reforms.
I have seen lots of Americans here complaining on stress and taking stress releivers and yoga.I am sure their life expectancy would be reduced to 1/2 of what they have if they were to undergo immigration inside America now especially from retrogessed countries.Serious its not a joke.:D
Yes WD,we will make Michigan a role model.

I bet they have only issued around 120,000 EB visas in the year 2006 (Oct 2005 - Sept 2006), even though the quota is around 250,000. (140,000 direct + 100,000 from family other category).
TheLPR flow for EB was 159,081 in 2006.
Employment Preference Limit
The annual limit is equal to 140,000 plus unused FS preferences in the previous FY. There were 3,949 unused FS preferences in 2005. The 2006 EB limit was 143,949 (140,000 plus 3,949). The REAL ID Act of 2005 recaptured 50,000 unused EB visas, 5,125 of which were used in 2005. In 2006, 33,341 of these visas were used, exceeding the 2006 limit.

Thank you for writing to me regarding our country's immigration system.
Our nation's immigration and border security system is broken and must be fixed. We must require illegal immigrants to step forward and become legal and we must better secure our borders. We must restore the rule of law and enhance security at our borders. The Congress and the President must work together to reform our laws. We also must use the full force of the law against employers who hire illegal immigrants.
I support changes to the law that will require illegal immigrants to become legal. They must pay taxes, learn English, and pass criminal background checks. This process won't be easy or quick, but it will be fair and practical. Individuals who came to this country illegally will be bumped to the back of the line behind those who waited to come to this country legally. And illegal immigrants with a criminal record would be deported. Those who refuse to register and meet these conditions also should be deported.
To secure our borders, the government should require the use of a biometric entry-exit system for all land borders, so that we have an accurate record of who is entering and leaving the United States. We should create a "smart" enforcement regime which will produce more efficient inspections and screenings, and allow us to target and tailor our limited resources to combat illegal smuggling of people and contraband. I supported recent appropriations that provided $1.6 billion for border security fencing, infrastructure and technology, and facility construction, as well as the hiring of 3,000 new Border Patrol agents.
To meet the needs of our workforce and promote family reunification, we should set in place realistic immigration numbers and policies, and clear the backlog of legal visas, green card legal permit resident and citizenship applications. Senator Feinstein has introduced the "Agricultural Job Opportunities, Benefits and Security Act", S. 1038, in order to provide for new blue card visas and modify the H-2A program. Senator Mikulski has introduced the "Save our Small and Seasonal Businesses Act", S. 388, to extend the annual cap exemption for returning H-2B workers. While these two bills address key issues in the immigration debate, a comprehensive approach is the only way to adequately deal with this issue.
We can no longer ignore corporations who are hiring and exploiting illegal workers. This practice takes jobs away from Americans and depresses wages for everyone. These unlawful companies must be prosecuted and face stiff criminal and civil penalties. We need smart policies like improved border patrols, full enforcement of our laws, and requiring illegal immigrants to become legal.
The status quo is not working. Allowing 12 million to hide in the shadows and live in this country illegally is unacceptable. Our system must be fixed. Again, thank you for writing to me regarding this important issue. If I can be of any further assistance please do not hesitate to contact me in the future.

Here are some steps to help you GET OFF YOUR BUTT!!
One Goal: Green Card Reform Rally
Find inspiration: Read about other's who have decided to join.
Get excited. Read as much about it as possible, and visualizing what it would be like to be successful (seeing the benefits of the goal in your head), get excited about the goal. Once youve done that, its just a matter of carrying that energy forward and keeping it going.
Build anticipation. Make it the most important date in your life.
Post your goal. Post it at home and work. Put it on your computer desktop.
Commit publicly. Update your profile
Think about the benefits, not the difficulties. The benefits will help energize you.
Squash negative thoughts; replace them with positive ones. Squash, This is too hard! and replace it with, I can do this!"
Tip: Google 'Get off your butt' and find more motivation.
Please think about the amount of effort that is going on to plan for this rally.
- The mental effort required to plan the logistics of such a huge event
- The physical energy required to make all this a possibility
- The amount of time the members working on this are sacrificing.. time that they could have spent with family or other gainful things
- The financial impact this is causing on the invloved members
and all not for themselves but for all of US.
What is your contribution to this effort. Please show up.
Think .. I am sure you can DO IT.

Logiclife,
IV is a voluntary organisation. You can request people to volunteer, but cannot force them or scold them for not volunteering. This is not professional. They might have their reasons and the right to work their way. I agree with your frustration when people who signed to turn up do not show up. But I feel this is not the way to express it.
Ram
It is a voluntary organization, and like any other voluntary movement unless people contribute their time, money & effort IV will not be successful.

I never knew Hindi is a local language in US:D Moreover I dont have anything against Hindi or any other language. Its the personal experience with people on more than one occasion.
You should know that Consulates and Embassys , even though in a foreign land, are considered a part of the nation they represent. So, legally Indian consulate is NOT in US land , it is in Indian land .
Just the way some people faced rude behaviour and inconvenience for not knowing Hindi, I have faced equal rude behaviour , inconvenience and outright cheating for not knowing Tamil during my trip to Chennai and Madurai. Should I forma general opinion about Tamilians ?
