That is absolutely right. I would also extend the argument from the perspective of the sponsoring employer.
The excessively longer wait would make the employer biased against hiring people from retrogressed countries with similar skills/experience.
Especially since this is an employment based category, I believe your line of argument should work!

Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...
If things make you sick .... there is a fix for it .... go to a doctor ...

Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.

Just based on the definition given by DOL I decided Level III and Level IV to be EB2. Besides I am EB2 and my wage level is Level IV. I agree it is hard to conclude the cat based on wage level, I saw there were some Senior welders in Level III as well as Vice presidents of the companies. Quite a contradiction isn't it!!
I think Level indicates the Step within the existing Job Title. For example, a Senior Programmer Analyst could have a level 2 or 3 but an Entry level Project Manager could have a level 1 or 2. I think one would have to use a combination of Level and SOC Code.

See so many ppl getting their EADs in 15-20 days. Mine was filed in first week of May at NSC, still no news. From the LUDs, it doesn't appear anyone has touched the applications yet.
Are these fast approvals only from TSC or there r ppl from NSC who see 15-20 day approvals?
so far almost all NSC approvals I have seen are >30 days. TSC is the one with the 2-3 week turnaround time! Even at I-140, mine sat on some shelf in NSC gathering dust for almost a year, while TSC was turning those around in a few months.

Good to hear some good and not so good reviews about the immigration lawyers in this thread. One of the firms about which folks have written contradictory statements is Fragomen. Thay have been very responsive and professional in some cases but the user polulation in general has complained about their non responsiveness. They have advised their clients ( i.e the companies) about how the slow down the process for green cards for their employees. It has been seen in a multitude of cases that they have advised the companies of not filing for EB-2 cases and use the route that creates the most delays in GC processing thus maximing the revenues for themselves and helping the companies use GC processing as a tool for employee retention. They made employers to belive that letting the cases processed in BEC is the best option instead of capturing the PD's from the old cases to PERM. Now, several thousand of those cases are still languishing at BEC and no one seems to have an answer about what will happen to those after 17th August.Isn't that so so unfair......
Their practice can not be termed ethical and the employees need to highlight this issue with their senior management and HR. I was wondering if Immigration Voice can help those individuals by guiding them about appropriate steps to highlight the malpractice by Fragomen.

As I mentioned earlier, it is a simple RFE. In addition, Desi has backedup his suggestion with the proof - Just ask your attorney to respond to the RFE. Post back when you get updates, it will help IV community, who are in similar situation and also the members who do not have a proper understanding of statuses.:D

The reason we see progress year after year with Schedule A and nothing happens in EB reform because there is no corporate support for EB reform. This is one of the reaons why we should be open for measure like 485 whenever possible, even after febuary 15th.
Maybe we need to figure out how we can involve the corporations in EB relief. The only reasons we see Schedule A relief every year because there is a strong health industry lobby driving this. the worst part about this is that these 90,000 and 50,000 which were released last year and they are trying now are comming from the unused\recaptured visas from previous years. there is no country limit in the unused\recaptured visas for Schedule A.

There is no statutory requirement on wait time. You may not even be an employee when your future employer files for your PERM as green card is for future job.
It's up to your company policies and your "persuasion skills!"

If you get an MBA from Sloan or Wharton or Harvard or Berkeley, nothing like it. I know of few people who have not done very well after getting MBAs from these schools. If you want to continue writing comp. programs, then of course there is no need for it. But how many people want to do it forever?
But I agree with Tito to some extent. Especially, if the degree is from even a slightly lower ranked school like Arizona or Northwestern, the returns are not there, and there is a great deal of evidence in that direction.
Having actually studied this data (and being in the business of teaching) gives me some perspective.
But it's still just my 2 cents.

My labor is approved and filed for I-140 about a year ago and still hasn't been approved. Now, my PD is current based on yesterday's Visa Bulletin. Can I file another I-485 for me with a pending I-485 thru my wife's employer?"

yes, you can file a 485 based on your PD. But it will be processed only after your 140 is approved or while it is being processed.
OR, you can wait, and once your 140 is approved and provided your PD is still current, you can transfer your wife's 485 to yours making you the primary and the wife the dependent.
