Right now the question is hypothetical as we don't have a overwhelming confirmations of 100+! Even a crowd of 25 is okay, if we can reach that number. Since this is the first ever MI level meet, I will be surprised (and happy too) if we cross 25-30.
If it's 100+ a new level of pre-planning will be necessary. Our leaders ( cagedcatcus? chintu25?) will need to book a hall, set a clear and focused agenda (so that we don't lose focus), get IV core to address us by telephone/speaker phones, they can even persuade an Immigration attorney (trying to reach out to future clients) to address our questions etc.. It will be a different ball game! It can be handled effectively without limiting numbers.

Ok..I know I should read thru the older posts, but didnt get a sense of what is required in my case, so I am posting the question online.
My wife was on her independent H1B. she travelled out side the country and was readmitted on H1b. After that she turned in her 2 weeks notice and has started working for another company on her EAD.
We have not applied for our AP previously.
My question is this:
In Part 1 , Q3
Class of Addmission
Should she put H1B (last admitted as)
or would it be Adjustment of Status (since she is using EAD)
Also, what kind of supporting documents need to be sent?
I-485 copy
EAD Copy ( yes/ no)
I-94 H1B issued at POE (yes/no)
2 passport sized photographs?
anything else?

One of my friend is currently working for a company A. He has got offer from a reputed university and is interested in transferring his H1. The question is,
1> can he transfer his H1 from a 'for-profit' to a 'non-profit'?
2> In future if he decided to work again for a 'for-profit', can he transfer his H1 from 'non-profit' to 'for-profit' without being counted against the cap?
Gurus please share your knowledge on this.

Has your company sent a termination letter to INS? Have they paid you for your travel back to India?
I may be wrong, but I think those two are necessary for an employer to invalidate a H-1.
Does anybody know how long an H1B visa can remain valid (including grace period) after a layoff ? What I know, is an H1B technically becomes invalid the day you stop rendering your services to your employer. The firm's lawyer suggested me to file for B1/B2 visitors visa to avoid going out-of-status.

You need to file for I-140 before 10/1/07.
For that you need to have an aproved Labor.
Bear in mind this is just one of the opinions out there (albeit the most prevalent)

To the major headache we will be facing. Economy.

Can you throw some light... I am scared. Looks like you got some insider info.
Not insider information but I do have access to a lot of rfe's and issues that are going on in the EB community:
USCIS revoking approved I-140's
USCIS adding up all 140's together and asking companies to prove ability to pay for all candidates together
department of labor auditing just about every eb2 labor
vermont and california service center giving very difficult rfe's to h-1b's - change of employers and extensions (they are actually denying them to)
Consulates sending complaints to department of labor when h-4 goes for visa stamping and they see primary hasn't received paystubs from entry into usa
companies closing down because fines/penalties from department of labor are too much.
random visits from department of labor and ICE to employee homes
IRS auditing per diems
It really seems that the government is making a concerted effort in giving the employers and employees a very difficult time. Started getting tough in 2004 but have really ramped it up a notch in last nine months.

The problem is not ingrained in the airline . Most of the Europeans would rather cut each other than talk to each other . I worked in germany which is also kind of like France and they hate the French more than anything else . I had a magazine in my hand and was looking at a nice picture of a French car , my German remarked , that is a very bad car because it is 'FRENCH'. Hundreds of years of war and strife have left the european countries little fortresses in themselves who have their own little language and culture . English is not accepted or frowned upon in most countries , because English is the language of the British and we are not British .
Air France being an international Airline should have known better . Air France needs India a lot lot more than India needs Air France . We have hundreads of Airlines Vying to ferry our passengers across the Atlantic and could very well do without Air France . By the way I also transited through Paris once and has issues with language . People in France speak in French even when they clearely see that the passanger does not understand French and has no clue to the happennings .
The French consultate in India should be get into this and provide a Government Apology to the matter at hand . The Indian Govt also kept quiet on the issue . India does not need diplomacy with France one bit . We have very little trade with them anyways .

It is hard to compare Canada vs India. India as other problems. If you want finance sector jobs then it is Bombay. It involves long travel
of 2 hours in locals each way. 4 hours travel...there is no personal time left after work. I personally cant take it...it might be different
for others. Power problems, traffic jam etc is there. It about what you consider quality of life, and that is different from person to person.
coming to US/Canada vs india, my friend who went back to india after 6 yrs here on h1b last april, says that he has adjusted back to his life there.......he has power cuts,limited water supply,traffic jams,long commute,sarkari issues like bills etc (hes in delhi)but he has accepted that as a part of life just like the first 25 yrs of his life when he was in india......so its very subjective and a matter of personal choice.......if u are ready to adapt,then u will be fine but if u always keep comparing ur lifestyle here v/s in india in terms of "quality of life" then u'll not b satisfied

Do not give misleading information. When you do the transfer the original visa is not cancelled. In fact you can have more than one H1B at the same time and work for them. For example two part time jobs for different employers. But the only catch you should always work only for the sponsoring company. If you decide not to join them at all, you can do so. But you have to maintain the status thru your current employement or another employer.

But there needs to be 2 seperate independent I-129's filed by both employers for you to do this.

People are always under the impression that because they already hold an H1, then it is easy to get "transferred" to another company.
In this case, the only thing you actually "transfer" is ...yourself and nothing else. The only advantage of already having an H1 is that you don't have to worry about the quota anymore, you are exempted from it.
Since you have to file a new case, approval can never be guaranteed and it is therefore always risky to switch employers (as soon as the new H1 is filed), without waiting for approval. Tricky stuff...
