what does this mean ?

Everytime you want to switch employers, a whole new H1 must be filed.
People are always under the impression that because they already hold an H1, then it is easy to get "transferred" to another company.
In this case, the only thing you actually "transfer" is ...yourself and nothing else. The only advantage of already having an H1 is that you don't have to worry about the quota anymore, you are exempted from it.
Since you have to file a new case, approval can never be guaranteed and it is therefore always risky to switch employers (as soon as the new H1 is filed), without waiting for approval. Tricky stuff...

I agree, India is a far better option.
Assuming this discussion is about immigration/permanent-settlement and not about short term visits, work and study.
On the side note, The only problem faced in india is over population which triggers almost all other issues. If india implements onechildpolicy most of the problems faced today will disappear in few decades. Your child (note: singular) need not leave india to enjoy international level lifestyle & benefits.
As a backup plan to greencard advocacy we need to lobby the indian government to implement onechildpoilcy immediately.
You do realise that one of the biggest reasons for India's rapid growth is it's population right? It is both a boon and a curse. And if you "enforce" a one child policy, there will be a rapid decline in population. There will be major social problems, what happens to a couple if their only child dies in teenage?. Apart from obvious social issues (kids will have fewer cousins and fewer relatives), the biggest problems will arise in 30 years when the severely depleted young populace will have to support the huge number of retired old workers either directly through parental support or indirectly through taxes.
Think of your old age too, these solutions look interesting, but it will kill the very reasons that make India attractive today.
A gradual stabilization of population by encouraging families to have just two children through social programs is the way to go and I think India has done a good job of it in the last 2-3 decades. These things take time.

In other words all the I-140s filed after May 15th ( Or June 19th) will have to be re-filed under the merit system if they are not approved and GC received when the Bill is in effect. That Effective date is the one you are refering to. Introduction date is when the bill was added to the senate calander.

Visiting IV webiste after long time, (yes I got my GC :) ), feel nothing has changed, another flaming post from logiclife and he hopes it will touch egos of those ( as he calls them cowards), but my friend their skin so thick they won't even feel it,
I have been in this position, when I tried to start state chapter, I was not able to find single person, At that time I had EAD and sucessfully changed jobs, I knew many friends who were still in H1B and crib on every time how they have been exploited,
Anyway one thing comes to my mind, it still amazes how Mahatma Gandhi was able to inspire people out of this lot to do what they did

I disagree. I would expect a person to convey that they are not officially open despite the doors being open. I agree its not nice on customers part to enter before the office is officially open, but that does not mean the officer just threatens a countryman.
We should learn to respect our countrymen/women first. If I were to try to enter a business which is closed but doors are open, I can tell that someone would tell me that same verbally!
You took the words out of my mouth dude.. Lack of respect for fellow indians is something that I have noticed on several situations when I try to make friends with people especially Indians. Some, take things for granted.
Now I cannot blame them as people's behavior is driven by past experiences with fellows.. may be they suspect every other person as one of those pyramid schemes guys.. not sure.. I am far far away from those things though.
I have to tell you one thing, when ever I smiled at folks, they did return one except few who look the other way.. don't worry..keep smiling guys.. after all it costs nothing..

Good to hear some good and not so good reviews about the immigration lawyers in this thread. One of the firms about which folks have written contradictory statements is Fragomen. Thay have been very responsive and professional in some cases but the user polulation in general has complained about their non responsiveness. They have advised their clients ( i.e the companies) about how the slow down the process for green cards for their employees. It has been seen in a multitude of cases that they have advised the companies of not filing for EB-2 cases and use the route that creates the most delays in GC processing thus maximing the revenues for themselves and helping the companies use GC processing as a tool for employee retention. They made employers to belive that letting the cases processed in BEC is the best option instead of capturing the PD's from the old cases to PERM. Now, several thousand of those cases are still languishing at BEC and no one seems to have an answer about what will happen to those after 17th August.Isn't that so so unfair......
Their practice can not be termed ethical and the employees need to highlight this issue with their senior management and HR. I was wondering if Immigration Voice can help those individuals by guiding them about appropriate steps to highlight the malpractice by Fragomen.

Indeed it seems very few people are interested as most member may have their 485 submitted already. EB immigrants are a small minority of this country, yet we are only a small portion of this small minority. It is a sad fact, but it should not stop us from fighting..

After reading all the post mentioned by IV core, it is clear that no one can do anyting about it, there is no lobbyist that can force this to happen
So our struggle is useless, some may not agree to it because, they say they are pushing and trying to make voice that can be heard by the congress.
Congress did not listen to those million illegals on what grounds we expect our voice to be heard.

Having time off with my boss is traumatic to say the least. I am entitled to seven weeks vacation a year and barely get three most of the time. Even when I am off I get phone calls and have to leave contact numbers, that includes when I am with my parents in England.
Can you imagine asking for two days off to go to an immigration rally that just reminds him that I will be out of his employment jail some time in the not too distant future I hope.
My green card process is in its sixth year. Look forward to shaking off my shackles and moving on with life. Glad to say my husband now has an EAD so at least he is free to work and join the human race again.
I am sure many people are in this sort of situation since we are indebted to our employers which is one of the things we would like to change.

even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.
IMHO, I would always say, if it is legal and possible and beneficial, ppl should think of conversion.
