I'm so reliefed and excited to see the bulletin site after so many years...
At first it look like a prank to me, like what happened last month.
But now I 'm quite certain that that yes the dates did moved for EB2 category upto Oct-01-2005.
Its really a great great news after a long long time !!
Someday I will also complete my journey :)

My wife had a H1B working for company A from 08/2003 to 07/2005 (from I-94) and she filed another H1B application to work for company B in 05/2004. She got the notice, stopped working for company A and started working for company B. However, she never got the aprroval notice for the second H1B application. Actually this case is currently still pending. She worked for company B until 07/2005 which is the expiration date of the first H1B. She changed to F2 later in 07/2005. I was wondering if there is any problem about status or employment authorization for this period of time from 08/2003 to 07/2005.

As far as IV core/leadership is concerned, IV has standard "Talking Points" which were given to volunteers for "Meet the law-makers" event during DC Rally. Also there is a decent FAQ and guide on Lawmaker meetings. You can try to arrange a weekend conference call with IV core ( paskal or pappu) too. Chintu25 (sam) has experience in this matter (he setup the last call)
Here's something from my end, to get the discussion started so that we have some concrete agenda for 10/20. It would also help participants to come ready with their ideas. It's also something we can do from our end, instead of waiting for leadership to come to our rescue!
1) Introductions - each member introduces himself/herself briefly, describes his/her GC journey, his/her concerns, expectations from IV and what could make them active participants in the grassroots movements, how can they contribute to IV in membership drive, meet the press, meet the lawmakers, funding etc.
Idea is to comeup with a SWAT anaylis. Identify our collective strengths, challenges and areas for improvement.
Here are somethings that can be planned
a) If someone has good media contacts, he/she can setup meetings with news reporter, others with compelling stories like 6-7 years wait after applying GC, children aging out etc. can volunteer to talk on behalf of IV.
b) If someone has contact with Senators, Congressmen etc. they can be pivotal in setting up meetings. A person with strong communication skills and marketing skills can volunteer to present the facts and sell our case in the meetings. It's very important that whoever presents our case does it effectively as our case needs a hardsell
c) Guys who volunteer/have contacts at temples, mosques, churches, gurudwaras, schools, colleges, libraries etc. can pull strings to get us space in the announcement boards. Others can print out the material and actually go and post those flyers at the designated places.
.... and so on. By sharing work we can share the burden and achieve more than what's possible acting individually. It's important that we know each other to comeup with such ideas for collaboration
2) Publicity Campaign/Membership Drive - I need not stress the importance of these. Here's something we need to do at the meetings
a) Divide the areas between members. This will avoid duplication, redundancy [ two members posting at the same grocery store etc.].
Somebody please get a MI map! We will mark area for each member to cover. We will know which areas are well-served and under-served. Volunteers from Well-served areas can adopt some of the nearby under-served areas. Or we call give a holler here say - " we need someone from Armada"
b) Set concrete weekly/monthly targets for each member like I will do 5 groceries which are ABC,XYZ, ... next weekend. As each volunteer meets the target, he/she reports to the publicity campaign co-ordinator (yes, we need a co-ordinator too!). Data is compiled and presented month-end ( yahoo groups, teleconferencing) so we know if we met our self-targets - how much's done, how much remains to be done, why some targets were missed, lessons learnt, how to avoid next time etc.
3) Real Grassroots campaign - Lawmaker meetings need not only target Congressmen/women. Remember, the letter Gov. Schwarnegger and 13 others wrote to US Congress? Governors and local politicians can influence too.
We can target local politicians - state senators, Governor etc. We can try to persuade them to write letters to Congressmen/women supporting our cause. Congressmen/women do depend on these local politicians to win the elections. If they write letters it will carry more wait than our letters, they also may be easier to persuade with our contacts than top-tier politicians like Senators. Instead of concentrating at the top, we can try the 'bottom up' approach in-addition to 'Meet Congressmen' campaigns.
Some plans can be drawnup during the meeting. Again we need to set targets, monitor and analyze progress, come up with corrective action etc.
4) Funding Drive - Show me the money :)
We'll need to come out with a Contribution/Financial plan.
a) How each one of us contributing/plans to contribute to IV annually? We need to tally the figures to come up with State-level contributions which should be communicated with the IV core.
b) Financial targets/commitments need to be setup at IV national and state chaper levels. We cannot totally depend on IV core to run ads in local papers for e.g. If it takes $1000 for e.g. it may not be possible for one or two persons (the so-called leaders) to bear the whole burden, however if we can share it like $100 x 10 or $50 x 20 it help further our cause. TRANSPARENCY at local-level is a must to gain members confidence. So we need to budget, execute, spend and report the spending ( amongst contributors only, others please excuse)
c) It will also help setup the level-of-support that the State chapter, IV core can provide to members. In case help at USCIS HQ level, Ombudsman-level etc. are needed in his/her case a non-contributing member cannot expect the same service as a member contributing his/her mite to the campaigns.
The contributions need not only be financial. If someone's unable to contribute significantly financially, they should make it up by volunteering for other activity.
5) Identify the local Leadership Team - Since we are all volunteers here with full-time jobs, it's impossible for one person to handle the co-ordination, monitoring, reporting (to members and core) activities. A leadership team needs to be identified to share the burden.
Leaders need to understand that they are the public face of IV in Michigan. It's expected they take a lead in all local activities, and will be speaking to media, co-ordinating between IV core and chapter members. They need to be open to phone calls, and in a position to answer member queries on a timely fashion (otherwise members will lose faith in the local chapter and the movement will die)
Leadership team will publish a monthly action plan, targets, results of last month etc. complementing with IV national-level action items and plans.
6) Localized talking points to Senators - Since our Democratic Senators keep countering our cause with issues such as Workers (read American Workers protection) and Amnesty, we need to come up with solutions based on previous experience.
In addition to IV talking points, we can also talk about -
1) Protecting Workers by removing job-restrictions on Employer, Job-level, salary-level etc. to GC applicants. How this will help American workers too.
2) Impact of GC applicants immigrating to Windsor (Canada) on Michigan economy. Loss of state taxes, losses to grocery stores, electronic stores causing loss of jobs etc.
3) Michigan is facing a labor-crisis as most young people in MI are moving to greener pastures in search of better opportunities. This has resulted in jobs moving out of Michigan, reluctance of new businesses to enter MI etc. due to non-availabilty of local resources ( We can show some press reports to prove our point)
Only way to counter labor-attrition is to attract and retain Immigrant workers. Immigrant workers will only relocate and work in MI, if MI is perceived as an Immigrant-friendly state. Senators office can take the lead in positioning MI as an attractive destination for Immigrant labor. If successful this campaign can reverse job loss and reinvigorate Michigan economy.
I've posted my ideas to get the discussion started. Others, please share your ideas too.
....
Now lets start on the game plan.
We would need some help from our leaders here..... what are the crucial topics that shall be discussed, and who are the people in state that we should target?
I think, calling our senetors and possibly arranging a meeting with them would be on our top of the list. But lets meet and discuss first to decide what points shall be covered, and what shall be avoided....etc...

Core IV,
How does the House version of SKIL compare blow by blow with the senate provisions for EB in CIR. Does House version of SKIL include recapture of unused visas as well as a raise which was part of the CIR. Compete America report only talks about excluding spouse and depenedents in the House SKIL version for EB visa numbers
If you have some analysis can you please post. Thank You !
Very good news indeed.
In the US politics for some reason, certain issues seem to get clubbed together.
Sometimes it suits our purposes and at other times it is vexing. Clearly our issue of legal immigration does not create the type of backlash from conservative republicans that the issue of illegal immigration does. Hence when our circumstances necessitate that we have to try to board the CIR train to our goals I consider it unfortunate.
On the other hand when it comes to H1b immigration, every H1b increase has corresponded with some sort of provision(mainly recapture) of EB visas also. H1b increase has tremendous support and pressure from the powerful capitalist forces in this country. Just see how the Wall street Journal and Pres.Bush gives publicity to this issue. I doubt pure EB provisions can get that sort of visibility in spite of the tremendous work of organisations like IV.
In that sense the H1b cap being exhausted indirectly gives our issue more visibility and is a good development. Lets wait until the 20K US masters cap is also filled, then publicity will increase even more.
All in all it looks good that something will work for us by the end of this year. The pressure is building on congress to do something about EB immigration.

Yes, I used to say like this five years back when I had time and age in my hand. I assume you are in early or mid 20's. I will put it differently for you.
Assume there is a big pond which starts from 1 feet and gradually increases up to 100 feet. People with one year work experience steps 0.5 feet. There are life jackets(GC) floating around the pool and whoever is lucky is picking it up. There are guys like me who are already in 5th-6th feet deep without finding the lifejacket, but we are sure if we go further, may be 3-4 feet more we WILL find it. There are guys who are lucky to find a life jacket at 1,2,3 feet also and happily float to the shore passing us. The fifth feet guy is practically seeing how the 6th and 7th feet guys are struggling. May be they are seeing some one in 8 feet to 10 feet. Now a big Tsunami (retrogression) comes and drags all the jackets 20 feet down further. These guys are dejected and some of these guys even pull their spouse/kids in one hand when they float/swim.
Dont forget, it takes one year to step 0.5 feet. Every year the pond management drops a fixed number of jackets. These guys keeps their hope alive based on the above fact. But these guys are seeing some kids passing in motorboat(LC Substitution) paying that guy 10K and getting a life jacket. Hmm pain, but even if I had a chance I would have also done it.
Now comes your saying. When the deepest s...t guys talks about their fate down the line and how to take their family safe ashore, a guy at 0.5/1 feet shouts saying "Dont give up, it is like deciding to take a sanyas because you are tired of dealing with social issues".
If you are in 5+ feet, I take your statment. Otherwise, you will not understand what I am trying to say until you reach 5+ feet without finding a life jacket and also pulling your family in one hand and seeing your seniors struggling more in 8+ feet. :)
NOTE: BTW, no offense. I thought to express what I am saying in different way. I understand what you meant. Cheers.
I am in my late 20's and am going to finish my 7th year next month...you decide how many feet of water I am in.. Meanwhile I totally understand your argument that the situation is the most frustrating for people who have been here the longest. I'd say sharpen you swimming skills and then it wouldn't matter how deep the water is or how tall you are....I's say stick with it and endure hardship if you value the end result (GC ofcourse). Even if you decide to go back...whatever your age/experience be...never forget its never too late..Gandhi was 46 years old when he returned to India from SA after spending 22 years there..Still wasn't too late for him to start a revolution now... or was it ?:)
May be you might also want to change your handle...GCby3000 doesn't sound that optimistic

our prime minister wants us to come back to India. So his daughter may not be a good candidate for our GC issues.
Don't get me wrong, as the prime minister, he is interested in India progressing and using our talent for that purpose, not the US taking advantage of us.
He should ask his daughter to return to India first...practice what you preach.

Guys,
They are going to reject all applications. They want more money. The whole issue with July bulletin was More Money. DOS wanted USCIS to take 1000s of application in july. But USCIS fought back saying no way in july. We'll not take 1 application in july. We want more money...money .... money...

First of all, the interpretation of the new provisions itself is subjective. Different interpretations, corrections, amendments to interpretations, etc will lead to another mess, after the provisions pass into law. As you already know, IV volunteers are currently researching on the hard country allocation issue, which may arguably worsen the retrogression for Chinese/Indians.
Let us assume that we are still able to pass the final provisions including the provision for amended soft country allocation. Imagine the number of applications that will flood the USCIS if the priority dates are adjusted to allow for all the eligible applicants. Do you foresee another backlog formation similar to the backlog centers that were formed for reducing labor applications and the mess they are in, currently?. Please note that the staff for USCIS will not increase, atleast for the next 1 year, until they figure out the volume of applications created with the new law and identify the magnitude of the staff shortage.
Even though I do feel that the existing retrogression will ease, if the provisions under consideration are passed into law; however USCIS will still keep some form of retrogression to control the flow of applications, especially for the EB3 category. In such a scenario, it is preferable that the USCIS allows the 485 filing and provides the EAD. EB3 applicants will be better off knowing that their 485s/EADs are in process/available, while waiting for the GC. So, even if the Eb3 applicant has to wait for 2-3 years (instead of the current 5 years) to get his final GC, he is atleast not dependent on his current employer.
I think, 485 filing ability is critical to the plight of EB3 applicants.
I don't believe you are right. Cut-off dates are not established based on the USCIS workload and its staffing, but rather on the predicted balance between demand for and supply of GCs. Therefore if worst comes to worst we will see a backlog at the USCIS level again, ie their processing time will go way beyond today's 6 months. BUt if the DOS believes that they have enough GC available to meet the demand in each and every particular quarter they will adjust cut-off dates accordingly.

Not to take away from the spirit of your posting, but just to set the record straight - it was Immigrants Support Network.
cheers!

People feel as if they have achieved something big after getting an EAD. EAD is not a visa and EAD status is not a valid status. You in fact lose your h1b valid status once you invoke AC21.
I have personally seen people change their attitudes as if they have achieved a gold medal in Olympics and talk big about "'Fingerp[rinting", about AC21, as if they have written the AC21 law. Does anyone know how AC21 came into picture on the first hand? There was an advocacy group called "Immigrant Social Network" that was behind the AC21. Prior to that, EB rules were extremely stringent with no portability.
Everyone browses this website, gains knowledge and behaves as if he/she is an immigration expert and has achieved something big.
We have been cajoling people. To what extent?
Words cannot describe the amount of effort "needhelp" has been putting in. She still continues to be the same and claims that her morale will never go down and her commitment levels have increased. All the cowards, and so called smart asses - try to learn some good lessons from people like her.
Life is not all about shopping at Macys, talking about fingerprinting, and watching TV, and spending hours on phones talking about how dealstobuy is different from buy.com or not about how CVS pharma sells the same item for less rate than rite aid. Life is not all about "sitting here doing nothing and talking about how different countries are rising and why one MUST not care for his own good"
IV is a volunteer organization and every member is equally responsible member. If you try to elude, and act smart - it only reflects your dirty character.
If you are here, do something. Yes, atleast something that you feel you can do. Please do not cheat those who are working extremely hard for your cause.
cheers!

united nations...u have been saying what u just said for many years now. i remember ur epic fight with saras on that issue that caused u to leave immigration portal.
i think this modification of the interpretation of the law is mainly to prevent the massive loss of numbers. I think the DOS now realizes that USCIS cannot effectively handle processing of the massive release of visa numbers in the last quarter, thereby they are doing it in an incremental manner so that the demand is handled effectively (USCIS standards effectively).
I agree; the law definitively leaves no room for error. If all the visas are held back until fourth quarter then there is a significant chance that visas will go unused.
However; it isn't in uscis/dos discretion to make such decisions on a whim for process improvement.
In the orgnizations we work in; there is a big consideration whether the new project or idea is feasible in the current environment. If it isn't then the project/idea gets shelved because it's not doable. However; congress and various regulatory bodies do not give such luxury to uscis. They don't ask them if the implementation of a law or creation of a law will fit into their system or workflow.
At a high level; country quotas in EB do not make a whole lot of sense. I have tried to figure out why they are there; how companies and candidates use EB greencards. Conclusion, I came up with is that in a lot of ways EB is a way to circumvent family base immigration. Many peoples parents have greencards, brothers, sisters, friends, etc; and they realize that it takes too long to get greencard through family base and the fastest way is to come through h-1b and go through EB route. Also; companies; company owners will favor their own people in filing h-1b's and greencards and then you have a situation where certain people are favored due to their nationality or connection. I firmly believe that uscis and the regulatory authorities understand this and hence the reason why there is country quotas.

i would love 'tomotto sauce'.. you are the kind of 'Donors' who disgrace IV or give wrong impression about IV - don't know how to carry out meaningful discussion.
Hand toasted pizza with tomotto sauce and garlic bread.
Or GC with Fedex overnight

I second the opinion who has posted at the start of this thread.
I have never seen such a horrible law firm. I and my wife both are working for large corp. I am on L1 and my wife on L2 EAD. Our sutuation is same as majority of yours
